Terms and conditions for using Fresh Basket

Welcome to Fresh Basket! These Terms of Service ("Terms") govern your use of our platform and services. By creating an account and placing an order, you agree to these Terms.
Acceptance of Terms
By accessing or using Fresh Basket, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of our services.
Account Registration
- You must provide accurate, complete, and current information during registration
- You are responsible for maintaining the confidentiality of your account credentials
- You must be at least 18 years old to create an account and place orders
- You agree to notify us immediately of any unauthorized use of your account
Placing Orders
- All orders are subject to product availability and acceptance by Fresh Basket
- We reserve the right to refuse or cancel any order for any reason (fraud, product unavailability, errors, etc.)
- Order confirmation does not guarantee delivery until payment is verified
- You are responsible for providing accurate delivery information
Pricing & Payment
- All prices are listed in Mexican Pesos (MXN) and are subject to change without notice
- You must pay 10% of the total order value upfront via bank transfer
- Upload your bank transfer receipt for verification before your order is confirmed
- The remaining 90% is due upon delivery (cash or online payment)
- Delivery fees: 50 MXN for orders under 200 MXN; FREE for orders over 200 MXN
Delivery Terms
- Deliveries are made the next day before 8 PM to the address you provide
- You must ensure someone is available to receive the delivery during the selected time slot
- Failed deliveries due to incorrect address or unavailability may incur additional fees
- Delivery times are estimates and may vary due to traffic, weather, or unforeseen circumstances
Cancellations & Refunds
- Orders can be cancelled before the day of delivery for a full refund of the advance payment
- Cancellations on the delivery day will result in forfeiture of the 10% advance payment
- Refunds for quality issues are processed as outlined in our Returns & Refunds Policy
IMPORTANT: Cancelling on the day of delivery means your advance payment is non-refundable.
Product Quality & Freshness
- We guarantee that all products are fresh, handpicked, and delivered within 24 hours of harvest
- If you receive damaged or poor-quality products, contact us within 24 hours with photo evidence
- Our 6-point quality check ensures every order meets our high standards
Limitation of Liability
To the maximum extent permitted by law:
- Fresh Basket is not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid for the specific order in question
- We are not responsible for delays or failures caused by events beyond our control (natural disasters, strikes, etc.)
Prohibited Use
- Using our platform for any unlawful or fraudulent purpose
- Attempting to interfere with, compromise, or disrupt our platform or servers
- Impersonating another person or entity
- Scraping, harvesting, or collecting data from our platform without permission
Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after changes constitutes acceptance of the new Terms.
Governing Law
These Terms are governed by the laws of Mexico. Any disputes will be resolved in the courts of Mexico City, Mexico.
